As a highly respected Dean of the Bankruptcy Bar, Mr. Togut has an impressive 45 years in the legal profession. He has spent decades honing his skills and is one of the most accomplished restructuring lawyers in the world, with a long list of contracts with high profile clients.
Mr. Togut started his firm Togut Segal & Segal LLP in 1980, acting as legal counsel to the official debtors committee. He was the primary owner involved in some of the largest and most publicized Chapter 11 cases of all time. He was an active member of the panel of directors of the Department of Justice in the southern district of new York. He has been trustee in several thousand bankruptcies under chapters 11 and 7 of the Bankruptcy Code. His resume includes a case for Refco, LLC, the largest Chapter 7 bankruptcy case in $ 4 billion.
Other high-profile cases he’s worked on include Anthracite Capital Inc., Axona International Credit & Commerce, and Limited Kingston Square. Mr. Togut attended New York University until 1971 and later graduated with a JD degree from St. Johns University. Mr. Togut chaired a working group of the Business Bankruptcy Committee of the Business Law Section of the American Bar Association. He also writes about his experience and lectures on a number of topics, such as the old Bankruptcy Act, the current Bankruptcy Code, conflicts of interest and ethics.
In addition, Mr. Togut is registered as a mediator in the southern district of new York. He has arbitrated over 100 adversarial proceedings, including with Solutia, which was settled for $ 220.5 million. He represented an appraisal expert appointed by the court to assist the court in the appraisal of a 10 billion dollars split between competing estate values, resulting in an uncontested confirmation hearing.
He is a Fellow of the American College of Bankruptcy, Fellow of the International Insolvency Institute, Co-Chairman of the Commission of the American Bankruptcy Institute, as well as a former Officer and Director of the ABI and Chairman of its New York City program. Mr. Togut served on the ABI’s Fee Study Board, which studied professional fees in Chapter 11 corporate bankruptcy cases.
He has been named New York Super Lawyer annually since 2007 and one of the Top 100 Lawyers in new York.
